[1]   المقدمة

1.1.   يرجى قراءة شروط وأحكام الاستخدام هذه بعناية قبل الوصول إلى منصة "حراج الأنعام" أو استخدامها، بما في ذلك التصفح أو إنشاء حساب أو طلب المنتجات، حيث تحدد هذه الشروط القواعد المنظمة لاستخدام المنصة.

1.2.   تعمل منصة "حراج الأنعام" كوسيط تقني يربط بين المستخدمين (البائعين والمشترين)، ولا تتحمل مسؤولية أي تعامل يتم بينهم خارج نطاق الخدمات المقدمة عبر المنصة، وذلك ما لم يُنص على خلاف ذلك في هذه الشروط والأحكام، وباستخدامك للمنصة، فإنك تقر بأنك قرأت هذه الشروط وفهمتها وتوافق على الالتزام بها قانوناً.

1.3.   لا تُعد منصة "حراج الأنعام" طرفًا مباشرًا في عمليات البيع والشراء، وإنما تقتصر مهمتها على توفير بيئة تقنية لعرض الأنعام وتسهيل إتمام العمليات بين الأطراف.

1.4.   يحق لمنصة "حراج الأنعام" التعديل على شروط وأحكام الاستخدام هذه في أي وقت، ويتم نشر التعديل على الموقع الإلكتروني الخاص بالمنصة. لذا ينصح بمراجعة هذه الشروط بانتظام للاطلاع على أي تعديلات عليها، وتُعد التعديلات سارية تلقائيًا بمجرد نشرها على هذه الصفحة.

[2]   التعريفات

يكون للكلمات والعبارات التالية المعاني الموضحة قرين كلٍ منها، ما لم يقتضِ سياق النص خلاف ذلك:

2.1.   "المنصة"، "نحن"، "لنا" أو "لدينا": يقصد بها منصة "حراج الأنعام" الإلكترونية المتخصصة في عرض وبيع وشراء الأنعام والمنتجات المختلفة، تتضمن هذه المنتجات عروضاً حصرية وصفقات مميزة على الخيول والجمال والمواشي والطيور ومستلزمات النحل. جودة عالية وأسعار تنافسية مع ضمان الأصالة والموثوقية.

2.2.   "المستخدم": يقصد به كل من يستخدم المنصة، سواء بصفة زائر أو من خلال إنشاء حساب سواء كان بائع أو مشتري.

2.3.   "الحساب": يقصد به حساب المستخدم (البائع أو المشتري) في منصة "حراج الأنعام" والذي يتم من خلاله إجراء المعاملة.

2.4.   "البائع": يقصد به كل من يبيع منتجاته على منصة "حراج الأنعام"، ويشار له بلفظ الجمع: "البائعين".

2.5.   "المشتري": يقصد به كل من يطلب المنتجات من البائعين من خلال منصة "حراج الأنعام"، ويشار له بلفظ الجمع: "المشترين".

2.6.   "المنتجات": يقصد بها المنتجات المعروضة على المنصة، ويشار لها بلفظ المفرد: "المنتج".

2.7.   "لوحة التحكم": يقصد بها رابط للمورّد مع اسم مستخدم وكلمة مرور فريدتين لإضافة المنتجات وإدارة الطلبات.

2.8.   "مزوّد خدمات الدفع": يقصد به الجهات التي تتعاقد معها المنصة والمرخّص لها من البنك المركزي السعودي لمعالجة المدفوعات الإلكترونية.

2.9.   "التصعيد": خدمة تقدمها منصة "حراج الأنعام" -من خلال فريقها المختص بتسوية المنازعات- تتمثّل في النظر في الشكاوى المقدمة من المستخدمين في حالة وجود أي مشكلات تؤثر على إتمام عملية البيع والتحكيم فيها، وفقًا لهذه الشروط.

2.10.  "المحتوى": يقصد به جميع المواد والمعلومات المتاحة عبر المنصة، بما في ذلك البيانات، النصوص، الصور، مقاطع الفيديو، الملفات الصوتية، الرسومات، الأيقونات، والتصميمات، والميزات التفاعلية التي يتم توفيرها أو إتاحتها للمستخدم.

2.11.  "القوة القاهرة": يقصد بها أي ظرف أو حدث خارج عن السيطرة المعقولة يحول دون تنفيذ الالتزامات التعاقدية، ويشمل ذلك – على سبيل المثال لا الحصر – الكوارث الطبيعية، الحروب، الاضطرابات، الأوبئة، القرارات الحكومية، أو تعطل أو انقطاع الخدمات التقنية أو اللوجستية بسبب عوامل خارجية.

2.12.  "حقوق الملكية الفكرية": يقصد بها جميع الحقوق المعنوية والمادية المتعلقة بـ براءات الاختراع، وحقوق التأليف والنشر، وحقوق البرامج، والحقوق الأدبية، والعلامات التجارية، وعلامات الخدمة، والشعارات، وحقوق قواعد البيانات، والمعلومات السرية، والأسرار التجارية، وأسماء النطاقات، وأي حقوق ملكية فكرية أخرى سواء كانت مسجلة أو غير مسجلة وفي أي مكان في العالم.

2.13.  "الشروط والأحكام": يقصد بها شروط وأحكام الاستخدام هذه، وسياسة الخصوصية، وأي سياسات أو إرشادات أو تعليمات مكملة، بما في ذلك أي تحديثات أو تعديلات تطرأ عليها، والتي تنظم استخدام المنصة والخدمات المقدمة من خلالها.

2.14.  "القوانين": يقصد بها جميع الأنظمة واللوائح والقرارات والتعليمات السارية والمعمول بها في المملكة العربية السعودية.

[3]   الإقرارات وأهلية الاستخدام

يعد وصولك واستخدامك للمنصة موافقة وإقراراً وقبولاً منك بما يلي:

3.1.   أن عمرك لا يقل عن (١٨) عامًا ميلادية، ولديك الأهلية القانونية والشرعية اللازمة للتسجيل في المنصة واستخدامها، وتنفيذ هذه الشروط والأحكام، والموافقة على منح أية حقوق أو أذون أو تراخيص بموجبها وفق ما تتطلبه الخدمة.

3.2.   أنك ستقوم باستخدام المنصة بحسن نية ولحسابك الشخصي فقط وليس بالنيابة عن أي شخص أو كيان آخر.

3.3.   أن جميع معلومات التسجيل التي تضعها صحيحة ودقيقة وحديثة وكاملة، وأنك ستحافظ على دقة هذه المعلومات وتُحدّثها على الفور إذا طرأ عليها أي تغيير.

3.4.   أنك لن تستخدم الخدمة في أي مشروع احتيالي أو غير قانوني، أو غير مصرّح به، بشكل مباشر أو غير مباشر.

3.5.   أنك مسؤول عن حماية بيانات الدخول الخاصة بك (اسم المستخدم وكلمة المرور).

3.6.   أنك ستراجع بعناية سياسة الخصوصية وأي شروط أو معلومات مهمة أخرى قبل إتمام أي طلب أو دفع.

3.7.   أنك غير خاضع لأية عقوبات وغير مدرج على أي قائمة تتعلق بأطراف محظورة أو مقيدة وأنك غير مملوك أو خاضع لسيطرة أي طرف من تلك الأطراف.

[4]   نطاق الخدمة

4.1.   منصة "حراج الأنعام" هي منصة إلكترونية تقدم خدماتها من خلال موقع إلكتروني عبر الرابط https://harajalanam.com وتطبيقها على الهواتف الذكية، وتتمثّل في الوساطة لتمكين المستخدمين البائعين من عرض منتجاتهم وتسهيل عملية بيعها للمستخدمين المشترين وفق ضوابط محددة وتحت مسؤوليتهم، بالإضافة إلى إدارة التعاملات بين البائع والمشتري وحل المشكلات التي تظهر خلال تقديم الخدمة عن طريق التصعيد للمنصة، مما يساهم في رفع موثوقية تلك التعاملات.

4.2.   لا تقوم منصة "حراج الأنعام" بمعالجة المبالغ المدفوعة من المستخدمين أو الاحتفاظ بها وإنما تقوم بإدارة الأذونات المتعلقة بها وفقًا لهذه الاتفاقية وتعليمات المستخدمين. وتتم معالجة المدفوعات والاحتفاظ بها من خلال طرف ثالث وهو مزوّد خدمة المدفوعات الذي تتعاقد معه المنصة.

4.3.   تكون مسؤولية منصة "حراج الأنعام" محدودة بما تقدمه من خدمات لتيسير المعاملة وإدارتها وفقًا لهذه الشروط والأحكام، ولا يشمل ذلك ما توفره عن طريق طرف ثالث كخدمة معالجة المدفوعات والاحتفاظ بها، ولا تقدم منصة "حراج الأنعام" أية ضمانات ولا تتحمل أي مسؤولية في حالة عدم التزام المستخدم -البائع أو المشتري- بهذه الشروط أو الأنظمة والقوانين ذات العلاقة بما في ذلك نظام التجارة الإلكترونية، كما لا تتحمل أي مسؤولية عن أي مخاطرة، أو أضرار، أو تبعات، أو خسائر تقع على المستخدم أو أي طرف آخر.

4.4.   دون الإخلال بما قضت به الفقرة السابقة إذا لحق بك ضرر ناجم عن عدم التزام أي مستخدم بهذه الشروط، يمكنك إبلاغنا بذلك عن طريق التصعيد لمنصة "حراج الأنعام" وسنقوم باتخاذ ما يلزم لتسوية المنازعة وفق الإجراءات المنصوص عليها في بند التصعيد الوارد في هذه الشروط.

4.5.   إذا وقع نزاع بينك وبين أي مستخدم فأنت توافق على إعفاء وفّي من جميع الدعاوى القضائية والمطالب والأضرار الحالية والتبعية الناشئة عن النزاع أو المتعلقة به بأي شكل من الإشكال، وبذلك فأنت تتنازل بشكل صريح عن أي حماية قد تعلمها أو تشتبه في وجودها لصالحك، إلى أقصى مدى مسموح به في الأنظمة والقوانين ذات الصلة.

4.6.   لا تتحمل منصة "حراج الأنعام" مسؤولية أي مبالغ يتم دفعها خارج المنصة من قبل أي طرف.

[5]   سياسة الحساب

5.1.   يجوز للمستخدم الاستفادة من منصة "حراج الأنعام" عبر إنشاء حساب مجاني أو التصفح كزائر وفق الخدمات المتاحة. ويعد إنشاء الحساب شرطًا لاستخدام بعض الخدمات مثل الشراء أو إدارة الطلبات أو برامج الوكلاء بالعمولة.

5.2.   يقر المستخدم ويضمن أن يتمتع بالأهلية القانونية الكاملة لإبرام عقود ملزمة وفقًا للأنظمة المعمول بها في المملكة العربية السعودية، وأنه قد بلغ السن القانونية اللازمة لاستخدام المنصة. وفي حال كان المستخدم يمثل جهة اعتبارية، فإنه يقر بامتلاكه الصلاحية القانونية للتصرف نيابةً عنها وإلزامها قانونًا بهذه الشروط.

5.3.   عند إنشاء حساب على منصة "حراج الأنعام"، يتعهد المستخدم بما يلي:

5.3.1.   تقديم بيانات صحيحة ودقيقة وحديثة وكاملة كما هو مطلوب في نموذج التسجيل.

5.3.2.   تحمل المسؤولية الكاملة عن صحة ودقة المعلومات المدخلة.

5.3.3.   تحديث بيانات الحساب فور حدوث أي تغيير عليها لضمان بقائها صحيحة ومحدّثة.

5.3.4.   يحق للمنصة التحقق من صحة البيانات المقدمة بأي وسيلة تراها مناسبة، ويُعد المستخدم مفوضًا للمنصة باستخدام هذه البيانات ومعالجتها وتخزينها وفقًا لسياسة الخصوصية المعتمدة.

5.3.5.   المحافظة على سرية اسم المستخدم وكلمة المرور الخاصة بحسابه، ويتحمّل المسؤولية الكاملة عن جميع الأنشطة والتصرفات التي تتم من خلال حسابه، سواء تمت من قبله أو من قبل أي طرف آخر استخدم بيانات الدخول الخاصة به، سواء بعلمه أو دون علمه أو موافقته.

5.4.   لا يجوز بيع الحساب أو التنازل عنه أو تأجيره أو مشاركته دون موافقة خطية مسبقة من المنصة.

5.5.   يحق لمنصة "حراج الأنعام" تعليق أو إنهاء الحساب عند وجود سبب مشروع يتعلق بالأمن أو مخالفة الشروط أو الالتزامات النظامية، مع احتفاظها بحق التقدير في الحالات الطارئة.

[6]   سياسة البائع

6.1.   يقرّ البائع ويتعهد بأن لديه الأهلية القانونية الكاملة والصلاحيات اللازمة لاستخدام منصة "حراج الأنعام" وعرض وبيع المنتجات من خلالها، وأن حسابه شخصي ولا يجوز له التنازل عنه أو نقله أو مشاركته مع أي طرف ثالث دون موافقة خطية مسبقة من المنصة.

6.2.   يلتزم البائع بالتسجيل عبر إنشاء حساب خاص به، وإدخال بياناته البنكية الصحيحة التي تعود إليه شخصيًا، والتي سيتم من خلالها تحويل مستحقاته المالية.

6.3.   يلتزم البائع ببيع المنتجات وفقًا للأوصاف المعلنة من قبله على المنصة، ويتحمّل وحده المسؤولية الكاملة عن أي اختلاف أو عدم مطابقة بين ما هو معلن وما يتم تقديمه فعليًا، وذلك دون أي مسؤولية على المنصة.

6.4.   يقرّ البائع بأنه يمتلك كافة الحقوق والتراخيص القانونية اللازمة لبيع المنتجات على المنصة، وأنها لا تنتهك أي حقوق للغير.

6.5.   يلتزم البائع بتغليف المنتجات – التي تتطلب الشحن أو التوصيل – بطريقة آمنة تضمن عدم تلفها، وبما يتوافق مع اشتراطات الأمن والصحة والسلامة المعتمدة في المملكة العربية السعودية.

6.6.   يتحمّل البائع المسؤولية الكاملة والمنفردة عن المنتج المبيع، بما في ذلك أي عيوب أو ضمانات أو التزامات نظامية وفقًا للأنظمة ذات العلاقة، بما فيها نظام التجارة الإلكترونية.

6.7.   يلتزم البائع بتقديم أوصاف دقيقة وصحيحة وكاملة لجميع المنتجات المدرجة من قبله، ويمتنع عن تقديم أي بيانات مضللة أو غير صحيحة أو مبالغ فيها.

6.8.   يلتزم البائع بعدم عرض أي منتج أو محتوى ينتهك حقوق الملكية الفكرية أو أي حقوق نظامية للغير.

6.9.   يقرّ البائع ويلتزم بالحفاظ على سرية وخصوصية بيانات المشترين التي تصل إليه من خلال المنصة، ويتعهد بعدم استخدامها إلا في حدود تنفيذ الطلبات.

6.10.   يلتزم البائع بتسليم المنتج وفق المواصفات المتفق عليها وطريقة التسليم المحددة بين الطرفين خلال مدة لا تتجاوز (خمسة) أيام عمل من تاريخ إتمام الدفع. وفي حال التأخر، يحق للمشتري رفع تصعيد، وفي حال عدم الشحن يتم إلغاء الطلب وإعادة المبلغ – بعد خصم الرسوم – خلال مدة أقصاها (14) يوم عمل وفق سياسة الاسترجاع.

6.11.   يتحمّل البائع كافة المسؤوليات والالتزامات الناشئة عن إدارة الحساب وتنفيذ الطلبات، بما في ذلك الاسترجاع أو إلغاء الطلبات أو غير ذلك.

6.12.   يلتزم البائع بالامتثال لكافة القوانين واللوائح والقرارات المعمول بها في المملكة العربية السعودية، بما في ذلك القوانين التجارية وقوانين حماية المستهلك والأنظمة الضريبية إن وجدت.

6.13.   يقرّ البائع بأن المنصة لا تضمن بيع الأنعام، وأن مسؤولية إتمام الصفقة وجودة الأنعام ومطابقتها للوصف تقع عليه بالكامل.

6.14.   يلتزم البائع بالتعاون مع إدارة المنصة لحل النزاعات التي تنشأ مع المستخدمين وفقًا للإجراءات المعتمدة من المنصة.

6.15.   يوافق البائع على أن أي قرارات أو إجراءات تتخذها المنصة في إطار إدارة النزاعات أو تطبيق السياسات تكون ملزمة له في حدود ما تسمح به القوانين المعمول بها في المملكة العربية السعودية.

6.16.   يحق للمنصة تعليق أو إيقاف أو إنهاء حساب البائع بشكل مؤقت أو دائم، واتخاذ أي إجراءات مناسبة، في حال مخالفته لأي من شروط الاستخدام أو السياسات المعتمدة أو القوانين السارية.

[7]   سياسة المشتري

7.1.   يجب أن يكون المشتري متمتعًا بالأهلية القانونية اللازمة لطلب المنتجات عبر منصة "حراج الأنعام" وفقًا للأنظمة المعمول بها في المملكة العربية السعودية.

7.2.   يلتزم المشتري بإنشاء حساب خاص به، ويكون المشتري مسؤولًا مسؤولية كاملة عن حسابه المرتبط برقم الجوال المسجّل أو عنوان البريد الإلكتروني الخاص به، ويتحمّل المسؤولية عن أي استخدام يتم عبر الحساب، سواء كان استخدامًا مصرحًا به أو غير مصرح به.

7.3.   يقر المشتري بأن المنتجات التي يطلبها عبر المنصة يتم توفيرها إما من البائع مباشرة أو من المنصة نفسها بصفتها بائعًا، ويتم تحديد البائع المسؤول في صفحة المنتج.

7.4.   يقوم المشتري باختيار البائع المناسب، ويكون مسؤولًا عن اختياره دون أي تدخل من المنصة أو إدارتها، ويعلم المشتري أن أسعار المنتجات قد تختلف من البائع لآخر.

7.5.   يلتزم المشتري بسداد قيمة المنتجات من خلال وسائل الدفع المعتمدة عبر المنصة فقط، ويقر بأن أي مبالغ تُدفع خارج إطار المنصة لا يُعتد بها.

7.6.   يقر المشتري بأن عمليات الدفع الإلكتروني تتم من خلال مزودي خدمات دفع معتمدين، وأن أي نزاع مالي يخص بوابة الدفع يخضع لسياسات مزود الخدمة المعني.

7.7.   يلتزم المشتري باختيار طريقة استلام المنتج فور إتمام الدفع، وتأكيد الاستلام عند وصوله. وفي حال عدم التأكيد خلال (5) أيام، تبدأ فترة الفحص ومدتها (يومان).

7.8.   تخضع عمليات الإلغاء والاسترداد للسياسات المعلنة على المنصة ولشروط البائع، ويقر المشتري بأن استرداد أي مبالغ يتم وفقًا لهذه السياسات والإجراءات.

7.9.   لا تتحمّل منصة "حراج الأنعام" أي مسؤولية عن جودة أو ملاءمة أو نتائج أي منتجات مقدمة من قبل البائع، ويتحمّل المشتري المسؤولية الكاملة عن اختياره للبائع.

7.10.   يقرّ المشتري بأن شراء الأنعام يتم بناءً على اختياره ومسؤوليته، وأن المنصة لا تتحمل أي مسؤولية عن حالة الأنعام أو مطابقتها للوصف.

7.11.   في حال إلغاء المعاملة لأي سبب قبل أو بعد التسليم، يتم إعادة المبلغ للمشتري بعد خصم العمولة والرسوم ذات العلاقة.

7.12.   تحتفظ منصة "حراج الأنعام" بحقها في حظر عضوية المشتري في حال خالف أي من البنود المنصوص عليها في هذه الشروط، أو قيام المشتري بتقديم طلبات وهمية أو الإساءة لنا بأي شكل من الأشكال.

7.13.   يلتزم المشتري بالتعاون مع إدارة منصة "حراج الأنعام" لحل النزاعات التي تنشأ مع البائع وفقًا للإجراءات المعتمدة من المنصة.

7.14.   يوافق المشتري على أن تكون القرارات التنظيمية الصادرة عن المنصة في إطار إدارة النزاعات ملزمة له في حدود ما تسمح به القوانين المعمول بها في المملكة العربية السعودية، ودون المساس بحقه في اللجوء إلى الجهات القضائية المختصة.

[8]   سياسة الدفع

8.1.   توفر منصة "حراج الأنعام" وسائل الدفع الإلكتروني من خلال بوابات دفع معتمدة ومرخصة داخل المملكة العربية السعودية، تشمل: البطاقات البنكية والائتمانية عبر بوابة الدفع وفي، خدمة "تابي" (Tabby) للدفع بالتقسيط، التحويل البنكي المباشر.

8.2.   يجب عليك التأكد من أن البيانات التي يدخلها أثناء عملية الدفع صحيحة ودقيقة وسارية المفعول، وفي حال استخدم بطاقة شخص آخر فيجب أن يكون لديه تفويض أو إذن باستخدامها.

8.3.   يقر المستخدم بأن جميع عمليات الدفع تتم عبر مزودي خدمات دفع خارجيين، ولا تحتفظ المنصة ببيانات البطاقات البنكية.

8.4.   قد تفرض بوابات الدفع رسومًا إدارية تختلف حسب وسيلة الدفع أو الجهة المزودة، وتُعرض هذه الرسوم — إن وجدت — قبل إتمام عملية الدفع.

8.5.   لا يعتد بأي مبالغ أو رسوم يتم دفعها خارج النظام المعمول به في منصة "حراج الأنعام"، ولا تتحمل المنصة أي مسؤولية عنها.

8.6.   يتم تأمين بياناتك بشكل صحيح من خلال استخدام أحدث تقنيات الحماية والتشفير الإلكتروني، وتؤكد منصة "حراج الأنعام" أننا لا نقوم بتخزين بيانات الدفع على أنظمتنا.

8.7.   يتم تحويل المبالغ المستحقة للبائع عن طريق حوالة بنكية إلى الحساب البنكي المحدد مسبقًا.

8.8.   يتحمل البائع مسؤولية التأكد من دقة تفاصيل حساب البنكي وأنه محدث لتجنب التأخير في السداد.

8.9.   يحق لنا إضافة وسائل دفع جديدة مستقبلاً أو إلغاء أي من الوسائل الحالية، وسيتم تحديث البيانات والشروط وفقًا لذلك.

[9]   سياسة العمولة والرسوم

9.1.   تفرض منصة "حراج الأنعام" عمولة على عمليات البيع التي تتم عبر المنصة، ويتم احتسابها وخصمها عند إتمام عملية الدفع أو عند اعتماد نجاح الصفقة من قبل المنصة وفق آلية التسوية المعتمدة.

9.2.   يتم تحديد نسبة العمولة أو قيمتها وفق ما يتم الإعلان عنه داخل المنصة، ويجوز للمنصة تعديلها أو تحديثها في أي وقت دون إشعار مسبق، على أن يتم تطبيقها وفق النسخة السارية وقت إتمام العملية.

9.3.   يوافق البائع على خصم العمولة المستحقة تلقائيًا من إجمالي قيمة العملية قبل تحويل صافي المبلغ إلى حسابه البنكي.

9.4.   في حال إتمام أي صفقة بين البائع والمشتري خارج المنصة، سواء بشكل مباشر أو غير مباشر، بعد عرض المنتج أو التواصل أو التعارف عبر المنصة أو نتيجة لاستخدامها، يلتزم المشتري بسداد رسوم خدمة بنسبة (2.5%) من قيمة الصفقة لصالح المنصة، مقابل خدمات الوساطة والتسويق وإتاحة الفرصة للتواصل بين الطرفين عبر المنصة.

9.5.   لا تُستحق العمولة في حال عدم إتمام الصفقة بنجاح عبر المنصة.

9.6.   يتحمل البائع رسوم الخدمة المستحقة عن العمليات التي تتم عبر المنصة من إجمالي قيمة المعاملة وفق ما هو معلن داخل المنصة.

9.7.   يتحمل المشتري جميع الرسوم الحكومية المترتبة على المعاملة، بما في ذلك ضريبة القيمة المضافة إن وجدت.

9.8.   في حال إعادة أي مبالغ للمشتري، يتم خصم رسوم الخدمة المستحقة وفق سياسات المنصة المعتمدة.

9.9.   يتحمل كلٌّ من البائع والمشتري رسوم التحويل البنكي أو أي رسوم مالية أو مصرفية تفرضها الجهات المزودة لخدمات الدفع.

[10]  إخلاء المسؤولية القانونية

10.1.   تقدم منصة "حراج الأنعام" خدماتها "كما هي" و "كما هو متوفر" دون أي ضمانات صريحة أو ضمنية من أي نوع، بما في ذلك (دون حصر) ضمانات القابلية للتسويق، الملاءمة لغرض معين، عدم الانتهاك، أو ضمان عدم وجود أخطاء أو انقطاعات.

10.2.   لا تتحمّل منصة "حراج الأنعام" أي مسؤولية عن أي خسارة أو ضرر ناتج عن أي فيروسات، هجمات إلكترونية، مواد ضارة أو مشكلات تقنية قد تؤثر على أجهزة المستخدم أو بياناته نتيجة استخدام المنصة.

10.3.   لا تتحمّل منصة "حراج الأنعام" أي مسؤولية مباشرة أو غير مباشرة أو تبعية أو عرضية أو خاصة أو عقابية عن أي أضرار تنشأ عن:

10.3.1. جودة، أو سلامة، أو دقة، أو توافر المنتجات التي يعرضها البائعين.

10.3.2. أي اتفاق يتم خارج المنصة أو دون استخدام وسائل الدفع المعتمدة.

10.3.3. أي نزاعات بين البائع والمشتري، بما في ذلك الإلغاء، الإرجاع، التعويضات، أو الشكاوى المتعلقة بالمنتجات.

10.3.4. أي خسارة في الأرباح أو المبيعات أو الإيرادات أو فرص العمل أو الشهرة أو السمعة أو أي خسائر غير مباشرة أو تبعية.

10.3.5. الاعتماد على أي محتوى أو روابط خارجية أو أدوات مدمجة في المنصة.

10.3.6. أي عطل فني، انقطاع مؤقت أو جزئي، توقف، أو اضطراب في المنصة.

10.3.7. التقصير أو التأخر في الأداء متى كان ذلك ناتجًا عن القوة القاهرة، أو الظروف الخارجة عن السيطرة (كالكوارث الطبيعية، الاضطرابات، أو التدابير الحكومية) التي تمنع أو تؤخر تقديم الخدمات.

10.3.8. تقصير المستخدم في الحفاظ على سرية وأمان حسابه أو اتباع إجراءات الحماية.

10.4.   لا تتحمل منصة "حراج الأنعام" أي مسؤولية عن صحة أو دقة أو جودة أو سلامة المنتجات المعروضة، ويقع ذلك بالكامل على عاتق البائع.

10.5.   يلتزم المستخدم بتعويض المنصة وإخلاء مسؤوليتها عن أي خسائر، مطالبات، أضرار، غرامات، أو رسوم قانونية تنشأ عن استخدامه الخاطئ أو المخالف للشروط أو القوانين السارية.

10.6.   تمثل أي تقييمات أو آراء أو تعليقات منشورة على المنصة وجهات نظر أصحابها فقط، ولا تعبر عن رأي المنصة أو تتحمل مسؤوليتها عنها.

10.7.   نسعى جاهدين لتوفير توافر المنصة على مدار الساعة، إلا أننا قد نوقف أو نعلق الخدمات مؤقتاً لأغراض الصيانة، التحديث، أو التطوير، دون إشعار مسبق، ولا نضمن إصلاح العيوب الفوري أو خلو المنصة من الفيروسات أو المكونات الضارة.

10.8.   تحتفظ منصة "حراج الأنعام" بحق إيقاف أو إلغاء حساب المستخدم فوراً وبدون إشعار مسبق في حال مخالفة هذه الشروط، سياسة الخصوصية، مع بقاء جميع الالتزامات والمسؤوليات الناشئة قبل الإيقاف سارية المفعول.

[11]  قواعد الترخيص والاستخدام المحظور

11.1.   تمنحك منصة "حراج الأنعام" ترخيصاً شخصياً محدوداً وغير حصري وغير قابل للتحويل وغير قابل للترخيص من الباطن، للوصول إلى المحتوى والمعلومات والمواد ذات الصلة والتي قد تكون متاحة من خلال الموقع الإلكتروني أو تطبيقها على الهواتف الذكية واستخدامها للأغراض الشخصية فقط، وبما يتوافق مع هذه الشروط.

11.2.   يحظر تمامًا أي استخدام يتجاوز الاستخدام المحدود لمنصة "حراج الأنعام"، بما في ذلك على سبيل المثال لا الحصر:

11.2.1. إعادة إنتاج أو عمل نسخة مطابقة للمنصة، أو بيع، أو إعادة بيع أي جزء منها، أو استخدامها لأغراض تجارية أو غير تجارية دون موافقة كتابية صريحة منا.

11.2.2. محاولة فك التشفير، أو تفكيك، أو إعادة هندسة أي من البرمجيات المستخدمة لتشغيل المنصة.

11.2.3. منع أيّ مستخدم من استخدام المنصة، أو انتحال شخصية أيّ مستخدم أو كيان آخر.

11.2.4. إرسال رسائل غير مرغوب فيها أو بريد عشوائي أو رسائل تدعم أي أنشطة غير قانونية.

11.2.5. انتهاك أي حقوق ملكية فكرية، بما في ذلك حقوق الطبع والنشر، العلامات التجارية، براءات الاختراع، الحقوق الأدبية، قواعد البيانات، أو أي حقوق أخرى تخصنا أو مُرخَّصة لنا أو تخص أطرافًا ثالثة.

11.2.6. التدخل في طبيعة تشغيل المنصة، بما في ذلك نشر فيروسات أو أي تقنيات أخرى مثل برامج الإلغاء الآلية، أو فيروسات أحصنة طروادة، أو التعليمات البرمجية الضارة، أو التقنيات المماثلة التي قد تعطل أو تتدخل في تشغيل أو توفير المنصة.

11.2.7. الوصول إلى أو التلاعب بالمناطق غير العامة في المنصة.

11.2.8. محاولة استكشاف أو فحص أو اختبار الثغرات الأمنية لأنظمة أو شبكات المنصة، أو اختراق أي تدابير أمنية أو مصادقة.

11.2.9. التلاعب بأسعار أي من المنتجات المعروضة.

11.3.   تحتفظ منصة "حراج الأنعام" بحقها الكامل في تعليق أو إنهاء الحساب فورًا عند مخالفة أي من الأحكام أعلاه، ويوافق كل مستخدم على تعويض منصة "حراج الأنعام" عن أي ضرر ناجم بشكل مباشر أو غير مباشر عن معاملة محظورة.

[12]  الدقة والأخطاء والمراقبة

12.1.   قد تحتوي المعلومات المعروضة في منصة "حراج الأنعام" على أخطاء مطبعية، أو عدم دقة، أو سهو فيما يتعلق بالمحتوى، الوصف، أو أي بيانات أخرى. تحتفظ منصة "حراج الأنعام" بالحق الكامل في تصحيح أي أخطاء، أو تحديث أي معلومات، أو تعديل أي بيانات في أي وقت دون إشعار مسبق.

12.2.   تحتفظ منصة "حراج الأنعام" بالحق في مراقبة جميع خدماتها للتأكد من الالتزام بالشروط والسياسات، والقواعد التشغيلية المعتمدة لديها.

12.3.   تحتفظ منصة "حراج الأنعام" بالحق في حذف أي محتوى ينتهك هذه الشروط، أو يعتبر غير قانوني، غير مرغوب فيه، أو ينتهك حقوق الملكية الفكرية للمنصة أو التزامات مزودي الخدمة/ المرخصين.

[13]  حقوق الملكية الفكرية والعلامات التجارية

13.1.   جميع حقوق الملكية الفكرية في الموقع الإلكتروني https://harajalanam.com وتطبيقها على الهواتف الذكية بما في ذلك على سبيل المثال لا الحصر، المظهر التجاري، والأسماء والعلامات التجاريّة، وعلامات الخدمة، والحملات الإعلانيّة، والتصاميم، والشعارات، والأيقونات، والأعمال الفنية، والرسومات، والصور، والفيديو، ومواد الجرافيك، والنصوص والخطوط، وواجهة المستخدم، وواجهة العرض، ورمز الكمبيوتر، والبرامج، وملفات الصوت، والمواد الرقمية، والوثائق، والبيانات، والأشكال، واختيار وتنسيق وترتيب هذا المحتوى، مملوكة لمنصة "حراج الأنعام"، أو تتحكم فيها أو مرخص لها، وتخضع إلى حقوق النشر وحقوق الملكية الفكرية الأخرى في المملكة العربية السعودية والمعاهدات الدولية.

13.2.   تحتفظ منصة "حراج الأنعام" بجميع الحقوق في جميع الأجهزة والبرامج والعناصر الأخرى المُستخدَمة لتوفيرها بما في ذلك العلامات التجارية سواء كانت مسجلة أم غير مسجلة، ويعدُ أيّ استخدام غير مصرح به أو نسخ أو تقليد أو تشويه للعلامة التجارية للمنصة يعد انتهاكًا لحقوقنا الواردة في قوانين حماية العلامات التجارية؛ وبالتالي نحتفظ بكافة حقوقنا في اللجوء إلى المحاكم والجهات الرسمية ذات الاختصاص للمطالبة بتوقيع العقوبات اللازمة وطلب التعويضات المستحقة الناتجة عن تلك السلوكيات.

13.3.   يُمنع منعًا باتًا بيع أو ترخيص أو تأجير أو تعديل أو نسخ أو استنساخ أو إعادة طبع أو تحميل أو إعلان أو نقل أو توزيع أو العرض بصورة علنيّة أو تحرير أو إنشاء أعمال مشتقة من أيّ مواد أو محتويات منصة"حراج الأنعام" دون إذن كتابي منا.

13.4.   يُمنع منعًا باتًا انتهاك حقوق الملكيّة الفكريّة أو العلامات التجاريّة أو التصاميم أو محتوى الخاص بمنصة"حراج الأنعام"، أو محاولة التعديل عليها أو استخدامها في أي أغراض غير قانونيّة.

[14]  التسويق للمنصة

14.1.   يحق لمنصة "حراج الأنعام" التسويق لخدماتها بجميع الوسائل التسويقية المشروعة، سواء كانت مادية أو إلكترونية، عبر الوسائل المقروءة أو المسموعة أو المرئية أو عبر منصات التواصل الاجتماعي أو غيرها من الوسائل المتاحة.

14.2.   يحق لنا استخدام التقييمات أو الآراء أو الإحصائيات المرتبطة باستخدام خدمات المنصة، سواء التي يقدمها المستخدمون أو الناتجة عن التحليل الفني، لأغراض ترويجية وتسويقية، شريطة عدم الكشف عن هوية المستخدم إلا بموافقته الصريحة.

14.3.    تلتزم منصة "حراج الأنعام" باحترام خصوصية المستخدمين عند استخدام أي محتوى لأغراض تسويقية، ولن يتم عرض أي بيانات شخصية أو حساسة دون الحصول على موافقة مسبقة من المستخدم.

[15]  التعويض

15.1.   يوافق المستخدم على الدفاع عن منصة "حراج الأنعام" والجهات المرخِّصة لها وكل مسؤول من مسؤوليها ومديريها وموظفيها ووكلائها وعدم إلحاق الضرر بهم وإبراء ذمتهم من وضد كافة الدعاوى، أو المطالبات، أو الغرامات، أو التكاليف، أو النفقات بما في ذلك أتعاب وتكاليف المحاماة والرسوم القانونيّة التي تنشأ عن أو فيما يتعلق بما يلي:

15.1.1. انتهاك أو خرق أو مخالفة شروط وسياسات وقواعد تشغيل المنصة.

15.1.2. انتهاك حقوق الملكية الفكرية والعلامات التجارية للمنصة، أو خصوصية المستخدمين الآخرين.

15.1.3. الادعاءات أو المطالبات الناتجة عن سوء استخدام المنصة.

15.1.4. اتخاذ أي إجراء من شأنه الإضرار بأعمال وسمعة المنصة سواء بشكل مباشر أو غير مباشر.

15.2.   يلتزم المستخدم بتعويض منصة "حراج الأنعام" عن أي خسائر أو أضرار قد تلحق بها نتيجة أي استخدام غير شرعي.

[16]  روابط المواقع الخارجية

16.1.   قد تحتوي منصة "حراج الأنعام" على روابط لمواقع خارجية خاصة بأطراف أخرى، نحن لا نتحكم في هذه المواقع ولا نؤيدها ولسنا مسؤولين عن أي محتوى أو إعلان أو مواد أخرى متوفرة على تلك المواقع.

16.2.   قبل تمكين أي من وظائف المشاركة في المنصة للتواصل مع أو زيارة أي من هذه المواقع، نوصيكم بمراجعة سياسة الخصوصية لكل موقع تزوره من مواقع الأطراف الثالثة.

16.3.   يخضع استخدامك لأي خدمات تمتلكها أو تديرها أطراف ثالثة لشروط وأحكام الاستخدام وسياسات الخصوصية لتلك الأطراف الثالثة، وتكون أنت المسؤول الوحيد عن جميع المخاطر التي قد تنشأ عن استخدام أيّ روابط لمواقع خارجية بما في ذلك المحتوى، أو المعلومات، أو الخدمات المتاحة عليها.

[17]  الإشعارات ورسائل البريد الإلكتروني

17.1.   تقوم منصة "حراج الأنعام" بالتواصل معك من خلال الوسائل الإلكترونية، كالبريد الإلكتروني، أو الرسائل النصية، أو إخطارات التطبيقات الداخلية، أو المراسلات على الموقع الإلكتروني أو غيرها. وتعدّ كافة الاتفاقيات أو الإخطارات أو المراسلات الأخرى التي نرسلها لك إلكترونيًا مستوفية لأي متطلبات قانونية بأن تكون بصورة خطية ويمكنكم التواصل معنا عبر وسائل التواصل المحددة من المنصة لخدمتكم بشكل أفضل.

17.2.   قد نزودك برسائل البريد الإلكتروني والإشعارات الفورية ورسائل أخرى تتعلق بمنصة "حراج الأنعام"، مثل التحسينات والعروض والأحداث والعروض الترويجية الأخرى، أو تحديثات حول شروط الاستخدام وسياسة الخصوصية، أو النشرات الإخبارية، الإشعارات الفنية، أو تنبيهات الأمان، أو الرسائل الإدارية، أو لأغراض تسويقية، أو وفقاً لما يقتضي القانون، أو لأغراض أخرى وفقًا لتقديرنا الخاص.

17.3.   يمكنك تعطيل استلام مثل هذه الرسائل والإشعارات من خلال اتباع التعليمات المرفقة في تلك الرسائل أو عن طريق النقر على رابط "إلغاء الاشتراك" أسفل الرسالة الإلكترونية. إلا أنه يجب التنويه إلى أنه في حال تعطيل هذه الإشعارات، قد يتأثر تمتعك بخدماتنا، وخاصة فيما يتعلق بالتحديثات الهامة مثل الإشعارات الأمنية والإدارية التي قد تؤثر على حسابك أو تجربتك بشكل عام.

[18]  السرية وحماية البيانات

18.1.   نستخدم البيانات الشخصية بالطريقة الموضحة في سياسة الخصوصية والتي تعتبر جزءًا لا يتجزأ من الشروط والأحكام، وعلى النحو المبين بمزيد من التفصيل في تلك السياسة.

18.2.   باستخدامك لمنصة "حراج الأنعام"، فأنت تقر وتوافق على جمع واستخدام بياناتك الشخصية بالطريقة المبينة في سياسة الخصوصية أو التغييرات التي تطرأ عليها.

[19]  إنهاء الاستخدام

19.1.   تدخل هذه الشروط حيز التنفيذ اعتبارًا من تاريخ تسجيل حساب، وتظل نافذة طوال فترة استخدامك للمنصة.

19.2.   يحق لنا إنهاء هذه الشروط في أيّ وقت دون إشعار مسبق في حالة عدم التزامك  بالبنود الواردة بهذه الشروط أو الإخلال بأي منها، أو تسبب استخدامك للمنصة بأيّ مشكلات قانونية لنا، أو إلحاق الضرر بنا أو إشراك أي جهة أخرى في تحمل أي مسؤولية من أي نوع سواء كانت مالية أو إجرائية أو غيرها و ذلك بناء على تقديرنا.

19.3.   يمكنك إنهاء هذه الشروط عن طريق التوقف عن استخدام المنصة؛ وعند الإنهاء، ستنتهي جميع الحقوق الممنوحة لك بموجب هذه الشروط. وستبقى جميع الأحكام التي يجب أن تظل نافذة المفعول بطبيعتها بعد الإنهاء، سارية بما في ذلك، على سبيل المثال لا الحصر، حقوق الملكية الفكرية وإخلاء المسؤولية والتعويض.

[20]  التعديلات

20.1.   قد نقوم بمراجعة هذه الشروط وتعديلها وفقًا لتقديرنا المطلق، وستحكم علاقتنا معك أحدث إصدار من الشروط، كما يجوز لنا تغيير أي من محتويات منصة "حراج الأنعام" أو تعديل أي خدماتها أو تعليقها أو إيقافها (بما في ذلك على سبيل المثال لا الحصر، توفير أي ميزة أو قاعدة بيانات أو محتوى) في أي وقت.

20.2.   يعد استمرارك في استخدام منصة "حراج الأنعام" بعد إجراء أي تعديل على هذه الشروط، موافقةً صريحةً منك على الالتزام بالشروط المعدّلة.

[21]  التصعيد وتسوية المنازعات

21.1.   يحق لأي من البائع أو المشتري تقديم طلب تصعيد عبر المنصة بعد إتمام عملية الدفع، ويتم إيقاف المعاملة مؤقتًا لحين البت فيها.

21.2.   يتولى فريق تسوية المنازعات التواصل مع الطرفين خلال مدة أقصاها (24) ساعة، ويلتزم الطرفان بتقديم المستندات المطلوبة خلال المهلة المحددة.

21.3.   يصدر فريق تسوية المنازعات قراره باستكمال المعاملة أو إلغائها كليًا أو جزئيًا، مع أو بدون تعويض، ويكون القرار ملزمًا للطرفين في حدود الأنظمة المعمول بها.

21.4.   في حال إلغاء المعاملة قبل استلام المنتج، يتم إعادة المبلغ للمشتري خلال مدة أقصاها (14) يوم عمل.

21.5.   في حال رفض المنتج خلال فترة الفحص وقررت المنصة إلغاء المعاملة، يتم إعادة المبلغ بعد إعادة المنتج للبائع خلال (14) يوم عمل.

21.6.   لا يحق للمشتري طلب تصعيد بعد قبول المنتج أو بعد انتهاء فترة الفحص دون اعتراض.

21.7.   في حال اعتماد استكمال المعاملة، يتم تحويل المبلغ للبائع خلال (7) أيام عمل.

21.8.   في حال توزيع المبلغ بين الطرفين، يتم التحويل خلال (7) أيام عمل وفق قرار فريق المنازعات..

[22]  أحكام ختامية

22.1.   تخضع هذه الشروط والأحكام وسياسة الخصوصية وكافة الالتزامات الناشئة عنها أو المتعلقة بها لأنظمة المملكة العربية السعودية، ويكون للمحاكم السعودية الاختصاص الحصري لأي منازعات قد تنشأ في هذا الخصوص.

22.2.   في حال أصبح أي حكم من أحكام هذه الشروط غير ساري أو غير قانوني أو غير قابل للتنفيذ، فان قانونية وقابلية تنفيذ الأحكام الأخرى لن تتأثر بأي طريقة كانت بذلك الحكم.

22.3.   يجوز لمنصة "حراج الأنعام" التنازل عن أو تفويض أي حق من حقوقها أو التزاماتها بموجب هذه الشروط و/أو سياسة الخصوصية -كليًا أو جزئيًا- إلى أي شخص أو كيان في أي وقت سواء بموافقتك أو بدونها. ولا يحق لك التنازل عن هذه الشروط -كليًا أو جزئيًا- ولا تحويل حقوقك أو ترخيصها من الباطن بموجب هذه الشروط، إلى أي جهة خارجية دون الحصول على موافقة كتابية مسبقة.

22.4.   إن عدم ممارسة منصة "حراج الأنعام" لأي حق من الحقوق المقررة له بموجب هذه الشروط، أو التأخر في ممارسته، لا يُعد تنازلاً عن هذا الحق، ولا يؤثر على حقها في ممارسته في أي وقت لاحق.

22.5.   لن تنشئ هذه الشروط أي علاقة شراكة أو وكالة أو توظيف بين المنصة والمستخدمين، وتقتصر العلاقة على تقديم خدمة وسيطة إلكترونية فقط.

22.6.   في حالة وقوع قوة قاهرة، يتم تعليق الالتزامات التعاقدية لحين انتهاء الظروف المؤثرة، دون أي مسؤولية قانونية على المنصة أو الأطراف المتضررة. ويتعين على الطرف المتأثر إخطار الأطراف الأخرى مع تقديم ما يثبت وقوع الحدث.

22.7.   العناوين والتسميات التوضيحية الواردة في هذه الشروط ذُكرت على سبيل التيسير فقط ولكنها لا تحدد أو تصف -بأي شكل من الأشكال- نطاق أو محتوى أي حكم من أحكام هذه الشروط.

22.8.   تشكل هذه الشروط وسياسة الخصوصية (وتحديثاتها من حين لآخر) الاتفاق الكامل بين منصة "حراج الأنعام" وبين كل من يستخدم خدماتها، وتحل محل الإصدارات السابقة من هذه الشروط.

22.9.   في حال تعارضت هذه الشروط مع أيّ إصدارات سابقة لها، فإنّ النسخة الحالية تكون هي السائدة.

22.10.   أعدت هذه الشروط باللغة العربية، وفي حال ترجمتها إلى لغة أجنبية أخرى، فإن النسخة العربية تعتبر اللغة المعتمدة.

22.11.   أنت تقر بأنك قرأت هذه الشروط وتوافق على الالتزام بجميع أحكامها، وتصبح هذه الشروط نافذة وسارية من تاريخ تسجيلك في المنصة أو بدء استخدامك لها.

[1] Introduction

1.1. Please read these Terms and Conditions of Use carefully before accessing or using the "Haraj Alanam" platform, including browsing, creating an account, or requesting products, as these terms establish the rules governing the use of the platform.

1.2. The "Haraj Alanam" platform operates as a technical intermediary that connects users (sellers and buyers), and does not assume responsibility for any transactions conducted between them outside the scope of services provided through the platform, unless otherwise stated in these Terms and Conditions. By using the platform, you acknowledge that you have read and understood these terms and agree to be legally bound by them.

1.3. The "Haraj Alanam" platform is not a direct party to sales and purchase transactions; rather, its function is limited to providing a technical environment for displaying livestock and facilitating the completion of transactions between parties.

1.4. The "Haraj Alanam" platform has the right to modify these Terms and Conditions of Use at any time, and modifications will be posted on the platform's website. Therefore, it is recommended to review these terms regularly for any updates. Updates become automatically effective upon posting on this page.

[2] Definitions

The following words and phrases have the meanings shown next to each, unless the context requires otherwise:

2.1. "Platform," "We," "Us," or "Our": refers to the "Haraj Alanam" electronic platform specialized in displaying, selling, and purchasing livestock and various products. These products include exclusive offers and special deals on horses, camels, livestock, birds, and beekeeping supplies. High quality and competitive prices with guaranteed authenticity and reliability.

2.2. "User": refers to anyone who uses the platform, whether as a visitor or by creating an account, whether as a seller or buyer.

2.3. "Account": refers to the user account (seller or buyer) on the "Haraj Alanam" platform through which transactions are conducted.

2.4. "Seller": refers to anyone who sells their products on the "Haraj Alanam" platform; plural form: "Sellers."

2.5. "Buyer": refers to anyone who requests products from sellers through the "Haraj Alanam" platform; plural form: "Buyers."

2.6. "Products": refers to the products displayed on the platform; singular form: "Product."

2.7. "Dashboard": refers to a supplier link with a unique username and password for adding products and managing orders.

2.8. "Payment Service Provider": refers to entities contracted by the platform and licensed by the Saudi Central Bank to process electronic payments.

2.9. "Escalation": a service provided by the "Haraj Alanam" platform through its specialized dispute resolution team, consisting of reviewing complaints submitted by users in case of any issues affecting the completion of the sales transaction and arbitrating them, in accordance with these terms.

2.10. "Content": refers to all materials and information available through the platform, including data, text, images, video clips, audio files, graphics, icons, designs, and interactive features provided or made available to the user.

2.11. 2.12. "Intellectual Property Rights": refers to all moral and material rights relating to patents, copyrights, software rights, literary rights, trademarks, service marks, logos, database rights, confidential information, trade secrets, domain names, and any other intellectual property rights, whether registered or unregistered, in any place in the world.

2.13. "Terms and Conditions": refers to these Terms and Conditions of Use, the Privacy Policy, and any supplementary policies, guidelines, or instructions, including any updates or modifications thereto, which govern the use of the platform and services provided through it.

2.14. "Laws": refers to all regulations, bylaws, decisions, and instructions currently in force and applicable in the Kingdom of Saudi Arabia.

[3] Acknowledgments and User Eligibility

"Haraj Alanam" is an electronic platform that provides its services through a website at the link https://harajalanam.com and its application on smart phones, consisting of mediation to enable seller users to display their products and facilitate their sale to buyer users in accordance with specific conditions and under their responsibility, in addition to managing transactions between sellers and buyers and resolving problems that arise during service provision through escalation to the platform, thereby contributing to the reliability of those transactions.

4.2. The "Haraj Alanam" platform does not process or hold amounts paid by users; rather, it manages permissions related to them in accordance with this agreement and user instructions. Payments are processed and held by a third party, namely the payment service provider contracted by the platform.

4.3. The responsibility of the "Haraj Alanam" platform is limited to the services it provides to facilitate and manage transactions in accordance with these Terms and Conditions, and does not include services provided by third parties such as payment processing and holding services. The "Haraj Alanam" platform provides no guarantees and assumes no responsibility if the user—whether seller or buyer—fails to comply with these terms or applicable regulations and laws, including the E-Commerce Regulations, nor does it assume responsibility for any risks, damages, consequences, or losses incurred by the user or any other party.

4.4. Without prejudice to the foregoing, if you suffer damage resulting from non-compliance by any user with these terms, you may notify us through escalation to the "Haraj Alanam" platform, and we will take necessary steps to resolve the dispute in accordance with the procedures set out in the escalation section of these terms.

4.5. If a dispute arises between you and any other user, you agree to fully release and waive all lawsuits, claims, and damages, whether present or consequential, arising from or related to the dispute in any way, and thereby you expressly waive any protection you may know or suspect exists in your favor, to the maximum extent permitted by applicable regulations and laws.

4.6. The "Haraj Alanam" platform does not assume responsibility for any amounts paid outside the platform by any party.

[5] Account Policy

5.1. Users may benefit from the "Haraj Alanam" platform by creating a free account or browsing as a visitor according to available services. Creating an account is a requirement for using certain services such as purchasing, managing orders, or affiliate commission programs.

5.2. The user acknowledges and warrants that they possess full legal capacity to enter into binding contracts in accordance with regulations applicable in the Kingdom of Saudi Arabia, and that they have reached the legal age required to use the platform. 5.4. The account may not be sold, transferred, rented, or shared without prior written approval from the platform.

[6] Seller Policy

6.1. The seller acknowledges and undertakes that they have full legal capacity and necessary authority to use the "Haraj Alanam" platform and to display and sell products through it, and that their account is personal and may not be transferred, assigned, or shared with any third party without prior written approval from the platform.

6.2. The seller is obligated to register by creating their own account, and entering their correct banking data that belongs to them personally, through which their financial entitlements will be transferred.

6.3. The seller is obligated to sell products in accordance with the descriptions announced by them on the platform, and bears sole responsibility for any discrepancy or non-conformity between what is announced and what is actually provided, without any responsibility on the platform.

6.4. The seller acknowledges that they own all necessary rights and legal licenses to sell products on the platform, and that they do not infringe any third-party rights.

6.5. The seller is obligated to package products—which require shipping or delivery—in a safe manner that ensures they are not damaged, in compliance with safety, health, and security requirements adopted in the Kingdom of Saudi Arabia.

6.6. The seller bears full and sole responsibility for the sold product, including any defects, warranties, or regulatory obligations in accordance with applicable regulations, including the E-Commerce Regulations.

6.7. The seller is obligated to provide accurate, correct, and complete descriptions of all products listed by them, and to refrain from providing any misleading, incorrect, or exaggerated information.

6.8. The seller is obligated not to display any product or content that infringes intellectual property rights or any regulatory rights of third parties.

6.9. The seller acknowledges and is obligated to maintain the confidentiality and privacy of buyer information that reaches them through the platform, and undertakes not to use it except within the scope of order fulfillment.

6.10. The seller is obligated to deliver the product according to the agreed specifications and delivery method determined between the parties within a period not exceeding (five) business days from the date of payment completion. In case of delay, the buyer has the right to file an escalation, and if not shipped, the order is canceled and the amount is refunded—after deducting fees—within a maximum period of (14) business days in accordance with the return policy.

6.11. The seller bears all responsibilities and obligations arising from account management and order fulfillment, including returns, order cancellations, or other matters.

6.12. The seller is obligated to comply with all laws, regulations, and decisions applicable in the Kingdom of Saudi Arabia, including commercial laws, consumer protection laws, and tax regulations if applicable.

6.13. The seller acknowledges that the platform does not guarantee the sale of livestock, and that responsibility for completing the transaction and the quality and conformity of the livestock with the description rests entirely with them.

6.14. The seller is obligated to cooperate with the platform administration to resolve disputes arising with users in accordance with procedures adopted by the platform.

6.15. The seller agrees that any decisions or actions taken by the platform in the context of dispute management or policy implementation are binding on them within the limits permitted by laws applicable in the Kingdom of Saudi Arabia.

6.16. The platform has the right to suspend, cease, or terminate a seller's account temporarily or permanently, and to take any appropriate measures, in the event of violation of any of the usage terms, adopted policies, or applicable laws.

[7] Buyer Policy

7.1. The buyer must possess the necessary legal capacity to request products through the "Haraj Alanam" platform in accordance with regulations applicable in the Kingdom of Saudi Arabia.

7.2. The buyer is obligated to create their own account, and is fully responsible for their account linked to their registered mobile number or email address, and bears responsibility for any use made through the account, whether authorized or unauthorized.

7.3. The buyer acknowledges that products requested through the platform are provided either directly by the seller or by the platform itself as a seller, and the responsible seller is identified on the product page.

7.4. The buyer selects the appropriate seller and is responsible for their selection without any intervention from the platform or its administration, and is aware that product prices may differ from one seller to another.

7.5. The buyer is obligated to pay the product value through payment methods approved by the platform only, and acknowledges that any amounts paid outside the platform's framework are not recognized.

7.6. The buyer acknowledges that electronic payment transactions are conducted through approved payment service providers, and any financial dispute concerning the payment gateway is subject to the policies of the relevant service provider.

7.7. The buyer is obligated to select the product delivery method upon completing payment, and to confirm receipt upon arrival. If not confirmed within (5) days, an inspection period of (two) days begins.

7.8. Cancellation and refund operations are subject to policies announced on the platform and seller conditions, and the buyer acknowledges that any refunds are made in accordance with these policies and procedures.

7.9. The "Haraj Alanam" platform does not assume any responsibility for the quality, suitability, or results of any products provided by the seller, and the buyer bears full responsibility for selecting the seller.

7.10. The buyer acknowledges that the purchase of livestock is made based on their choice and responsibility, and the platform does not assume any responsibility for the condition of the livestock or its conformity with the description.

7.11. If the transaction is canceled for any reason before or after delivery, the amount is refunded to the buyer after deducting the commission and related fees.

7.12. The "Haraj Alanam" platform reserves the right to ban the buyer's membership if they violate any of the terms provided in these Terms and Conditions, or if the buyer submits dummy requests or abuses the platform in any way.

7.13. The buyer is obligated to cooperate with the administration of the "Haraj Alanam" platform to resolve disputes arising with the seller in accordance with procedures adopted by the platform.

7.14. The buyer agrees that regulatory decisions issued by the platform in the context of dispute management are binding on them within the limits permitted by laws applicable in the Kingdom of Saudi Arabia, and without prejudice to their right to resort to the competent judicial authorities.

[8] Payment Policy

8.1. The "Haraj Alanam" platform provides electronic payment methods through approved and licensed payment gateways within the Kingdom of Saudi Arabia, including: bank and credit cards through the "Vimeo" payment gateway, "Tabby" installment payment service, direct bank transfer.

8.2. You must ensure that the information you enter during the payment process is accurate, complete, and valid, and if you use another person's card, you must have their authorization or permission to use it.

8.3. The user acknowledges that all payment transactions are conducted through external payment service providers, and the platform does not retain banking card data.

8.4. Payment gateways may impose administrative fees that vary depending on the payment method or providing entity, and these fees—if any—are displayed before completing the payment process.

8.5. Any amounts or fees paid outside the system used by the "Haraj Alanam" platform are not recognized, and the platform assumes no responsibility for them.

8.6. Your data is properly secured through the use of the latest protection and electronic encryption technologies, and the "Haraj Alanam" platform confirms that we do not store payment data on our systems.

8.7. Amounts owed to the seller are transferred via bank transfer to the pre-specified bank account.

8.8. The seller bears responsibility for ensuring the accuracy of their bank account details and that it is current to avoid delays in payment.

8.9. We have the right to add new payment methods in the future or cancel any of the current methods, and data and terms will be updated accordingly.

[9] Commission and Fees Policy

9.1. The "Haraj Alanam" platform imposes a commission on sales transactions conducted through the platform, calculated and deducted upon completion of the payment process or upon approval of the transaction's success by the platform according to the adopted settlement mechanism.

9.2. The commission rate or value is determined according to what is announced on the platform, and the platform may modify or update it at any time without prior notice, to be applied according to the version in effect at the time of transaction completion.

9.3. The seller agrees to have the applicable commission automatically deducted from the total transaction value before transferring the net amount to their bank account.

9.4. If any transaction is completed between the seller and buyer outside the platform, whether directly or indirectly, after the product is displayed or contact or acquaintance is made through the platform or as a result of its use, the buyer is obligated to pay a service fee of (2.5%) of the transaction value in favor of the platform, in consideration of mediation and marketing services and providing the opportunity for communication between the parties through the platform.

9.5. Commission is not due if the transaction is not successfully completed through the platform.

9.6. The seller bears the service fees owed for transactions conducted through the platform from the total transaction value as announced on the platform.

9.7. The buyer bears all government fees resulting from the transaction, including Value Added Tax if applicable.

9.8. If any amounts are refunded to the buyer, applicable service fees are deducted in accordance with the platform's adopted policies.

9.9. Both the seller and buyer bear bank transfer fees and any other financial or banking fees imposed by payment service providers.

[10] Disclaimer of Legal Responsibility

10.1. The "Haraj Alanam" platform provides its services "as is" and "as available" without any express or implied warranties of any kind, including (without limitation) warranties of merchantability, fitness for a particular purpose, non-infringement, or warranty of absence of errors or interruptions.

10.2. The "Haraj Alanam" platform does not assume responsibility for any loss or damage resulting from any viruses, cyberattacks, harmful materials, or technical problems that may affect user devices or data as a result of using the platform.

10.3. The "Haraj Alanam" platform does not assume any direct, indirect, consequential, incidental, special, or punitive responsibility for any damages arising from:

10.3.1. The quality, safety, accuracy, or availability of products displayed by sellers.

10.3.2. Any agreement made outside the platform or without using approved payment methods.

10.3.3. Any disputes between the seller and buyer, including cancellations, returns, compensations, or complaints related to products.

10.3.4. Any loss of profits, sales, revenue, business opportunities, reputation, or goodwill, or any indirect or consequential losses.

10.3.5. Reliance on any content, external links, or tools embedded in the platform.

10.3.6. Any technical failure, temporary or partial interruption, shutdown, or disruption of the platform.

10.3.7. Failure or delay in performance when resulting from force majeure or circumstances beyond reasonable control (such as natural disasters, disturbances, or government measures) that prevent or delay service provision.

10.3.8. User failure to maintain the confidentiality and security of their account or to follow protection procedures.

10.4. The "Haraj Alanam" platform does not assume responsibility for the accuracy, quality, or safety of products displayed, which rests entirely with the seller.

10.5. The user is obligated to indemnify the platform and release it from any losses, claims, damages, fines, or legal fees arising from their incorrect use or violation of the terms or applicable laws.

10.6. Any ratings, opinions, or comments published on the platform represent only the views of their owners and do not express the opinion of or be the responsibility of the platform.

13.2. The "Haraj Alanam" platform retains all rights to all devices, software, and other elements used to provide it, including trademarks whether registered or unregistered. Any unauthorized use, copying, imitation, or distortion of the platform's trademark constitutes a violation of our rights under trademark protection laws; therefore, we reserve all our rights to resort to courts and competent official authorities to demand the imposition of necessary penalties and claim compensation resulting from such conduct.

21.1. Either the seller or buyer has the right to file an escalation request through the platform after payment is completed, and the transaction is temporarily suspended pending resolution.

21.2. The dispute resolution team will contact both parties within a maximum period of (24) hours, and both parties are obligated to provide required documents within the specified period.

21.3. The dispute resolution team issues its decision to complete the transaction or cancel it wholly or partially, with or without compensation, and the decision is binding on both parties within applicable regulations.

21.4. If the transaction is canceled before product receipt, the amount is refunded to the buyer within a maximum period of (14) business days.

21.5. If the product is rejected during the inspection period and the platform decides to cancel the transaction, the amount is refunded after returning the product to the seller within (14) business days.

21.6. The buyer may not file an escalation after accepting the product or after the inspection period ends without objection.

21.7. If the transaction is approved for completion, the amount is transferred to the seller within (7) business days.

21.8. If the amount is divided between the parties, the transfer is made within (7) business days according to the dispute resolution team's decision.

[22] Final Provisions

22.1. These Terms and Conditions, the Privacy Policy, and all obligations arising from or relating to them are subject to the regulations of the Kingdom of Saudi Arabia, and Saudi courts have exclusive jurisdiction over any disputes arising in this regard.

22.2. If any provision of these terms becomes invalid, illegal, or unenforceable, the validity and enforceability of the other provisions shall not be affected in any way by that provision.

22.3. The "Haraj Alanam" platform may waive or delegate any of its rights or obligations under these terms and/or the Privacy Policy, wholly or partially, to any person or entity at any time, with or without your consent. You may not waive these terms, wholly or partially, or transfer, sublicense, or delegate your rights or licenses under these terms to any external party without obtaining prior written approval.

22.4. The failure of the "Haraj Alanam" platform to exercise any right granted to it under these terms, or delay in exercising it, does not constitute a waiver of that right, and does not affect its right to exercise it at any later time.

22.5. These terms will not create any partnership, agency, or employment relationship between the platform and users, and the relationship is limited to providing an electronic intermediation service only.

22.6. In the event of force majeure, contractual obligations are suspended until the affecting circumstances end, without any legal responsibility on the platform or the affected parties. The affected party must notify the other parties and provide evidence of the occurrence of the event.

22.10. These terms were prepared in the Arabic language, and if translated into another foreign language, the Arabic version is considered the official language.
